GableGauge Terms of Service

Last updated: September 14, 2026

These Terms govern your access to GableGauge, a service operated by Gabelgaugedotcom LLC. By creating an account, submitting a project, purchasing a lead, or using the service, you agree to these Terms and our Privacy Notice.

1. GableGauge is a marketplace

GableGauge is an independent information and marketplace platform. We are not a roofing contractor, construction professional, inspector, estimator, insurer, employer, or agent of any homeowner or contractor. Contractors are independent businesses responsible for their licenses, insurance, representations, pricing, contracts, workmanship, safety, permits, warranties, and legal compliance.

We do not guarantee that a contractor will contact or hire a homeowner, that a homeowner will hire a contractor, or that any project, lead, estimate, review, or business opportunity will produce a particular result.

2. Planning estimates

GableGauge estimates are informational planning ranges—not quotes, bids, appraisals, inspections, insurance estimates, or offers to perform work. Actual prices can differ because of field measurements, labor rates, material availability, roof condition, structural work, permits, taxes, disposal, access, weather, warranties, and contractor evaluation. A qualified contractor must inspect the property before providing a binding price.

3. Homeowner submissions and contractor contact

You must provide accurate information and have permission to submit all photos and documents. A project becomes eligible for contractor access only after you provide the contact authorization shown at submission. GableGauge may share it with no more than five participating contractors serving the area. You may withdraw permission for future sharing through Your Privacy Choices. Information already released cannot be retrieved, but contractors remain responsible for honoring applicable opt-outs.

4. Contractors and homeowner information

Contractors must also accept the Contractor Terms of Service, including credential requirements and responsibility for claims caused by their conduct. Contractors must provide accurate company information, remain legally authorized and properly insured where required, and use homeowner information only to respond to the specific submitted project. Contractors may not resell, disclose, scrape, enrich, or use homeowner information for unrelated marketing. Contractors must honor do-not-contact and privacy requests and comply with applicable calling, texting, email, advertising, and privacy laws.

5. Lead purchases, memberships, and refunds

Purchasing a lead provides access to information submitted for one homeowner project. It does not guarantee valid contact, a response, an appointment, a bid opportunity, or a sale. Memberships and lead purchases are governed by the Lead Purchase and Refund Policy. Prices and applicable discounts are displayed before payment. Payments are processed by Stripe; GableGauge does not store full card numbers.

6. Reviews

Reviews express the reviewer’s opinion and are not GableGauge endorsements. Reviews must reflect a genuine interaction. GableGauge may moderate content under the Review Policy, but does not promise to investigate or verify every statement.

7. Acceptable use

You may not misuse the service; impersonate another person or company; submit fabricated projects; purchase information for an unauthorized purpose; probe or disrupt security; automate access without permission; infringe rights; or submit unlawful, deceptive, threatening, or abusive content.

8. Suspension and termination

We may restrict, suspend, or terminate access when reasonably necessary to protect users, investigate suspected fraud or misuse, comply with law, address nonpayment, or enforce these Terms. You may stop using the service and request account deletion through Your Privacy Choices, subject to records we must or reasonably need to retain.

9. Disclaimers and limitation

To the fullest extent permitted by law, the service is provided “as is” and “as available.” GableGauge disclaims implied warranties and is not responsible for independent contractors, homeowner decisions, construction work, property damage, personal injury, lost business, indirect damages, or outcomes outside GableGauge’s reasonable control. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Responsibility and liability limits

To the maximum extent permitted by applicable law, our aggregate liability arising from the service will not exceed the greater of $100 or the amounts you paid GableGauge during the twelve months before the event giving rise to the claim. This limit does not apply to fraud, intentional misconduct, gross negligence, or any liability or remedy that applicable law does not permit us to limit. Consumer rights that cannot be waived remain in effect. This section does not limit an arbitrator’s authority to award relief required by law.

Business users agree to indemnify and defend GableGauge and its personnel against third-party claims, reasonable costs, and reasonable legal fees arising from their unlawful contact practices, unauthorized use of data, infringement, construction work, or material breach of these Terms, except to the extent caused by GableGauge’s own wrongdoing. We will give prompt notice, reasonably cooperate at the business user’s expense, and allow control of the defense by qualified counsel. No settlement may admit our fault or impose nonmonetary obligations on us without our written consent.

11. Binding individual arbitration

Please read this section carefully. If you affirmatively accept these Terms and do not opt out, you and GableGauge agree to resolve covered disputes through binding individual arbitration rather than a jury trial or class action, subject to the exceptions below.

This mutual agreement covers disputes concerning the service, purchases, accounts, representations, or these Terms, whether based in contract, statute, tort, or another legal theory. The Federal Arbitration Act governs this section. A court decides whether an arbitration agreement was formed and whether this section or its class-action waiver is enforceable. The arbitrator decides the merits of other covered disputes.

Before arbitration, either party may send a written dispute notice describing the claim, requested relief, and contact details. Send notices to support@gablegauge.com with the subject “Notice of dispute”; we will use your account email. The parties will try in good faith to resolve the dispute for 30 days after receipt. This informal process does not prevent timely filings needed to preserve a claim, seek urgent relief, or satisfy a legal deadline.

Arbitration will be administered by the American Arbitration Association (AAA), using its Consumer Arbitration Rules for consumer disputes and Commercial Arbitration Rules for disputes arising from business use. Current rules and filing instructions are available at adr.org. One neutral arbitrator will decide the dispute. Consumers may participate remotely or, where an in-person hearing is needed, in their county of residence or another mutually agreed location. Consumer fees, fee waivers, business fees, and arbitrator costs will follow the applicable AAA consumer rules; we will pay costs those rules assign to the business. A consumer may recover attorney fees and any individual remedy available under applicable law. The arbitrator will issue a reasoned written award.

Either party may bring an eligible individual claim in small claims court. This agreement does not prohibit complaints to government agencies, agency enforcement, claims that law excludes from predispute arbitration, or court proceedings to enforce or challenge an award as the law permits. Either party may seek temporary court relief needed to preserve rights pending arbitration. If AAA declines administration because of our failure to comply with its consumer requirements or pay required fees, you may pursue your claim in a court of competent jurisdiction.

To the extent permitted by law, covered claims must be brought individually, not as class, collective, consolidated, or representative actions. This does not waive nonwaivable rights to public injunctive relief. Any relief that cannot lawfully be arbitrated individually may be pursued in court; otherwise enforceable portions remain effective. Claims may be consolidated only with all parties’ agreement.

30-day opt-out: You may reject this arbitration agreement by emailing support@gablegauge.com with the subject “Arbitration opt-out” within 30 days of first accepting this version. Include your name and account email. No reason is required. Opting out does not affect access to the service; the remaining Terms still apply. If this section is unenforceable or you opt out, disputes may proceed in a court with jurisdiction. We do not claim that these Terms prevent every lawsuit.

12. Accounts, content, and platform ownership

You must be at least 18 and able to enter a binding agreement. Business representatives must have authority to bind their business. Keep account credentials secure and promptly report unauthorized use. You retain ownership of your submissions and grant us a nonexclusive license to host, process, reproduce, and deliver them as needed to provide the service and carry out your authorized sharing choices. This license does not override the Privacy Policy or authorize undisclosed data sales. GableGauge software, branding, and other platform materials remain the property of their respective owners.

13. Changes, governing law, and contact

These Terms apply prospectively when accepted. We will provide notice and seek renewed acceptance for material changes where required. Changes will not expand prior consent, retroactively impose arbitration, or change an already-notified dispute without agreement. Applicable federal law and the law of the consumer’s state of residence govern consumer rights; mandatory local protections remain available. Invalid provisions are severed only to the extent permitted by law. Failure to enforce a provision is not a waiver. These Terms and the policies expressly incorporated here form the agreement concerning the service.
